Texas National Guard seized Shelby Park on Jan. 10 and placed a wire gate at the entrance, blocking U.S. Border Patrol agents from entering. The 47-acre park, owned by the city of Eagle Pass, was being used as a staging area for Border Patrol agents under the direction of the Biden administration to process a massive wave of thousands of illegal immigrants crossing the Rio Grande in December. Now, the drainage area inside the park, once teeming with illegal immigrants, is empty; the Rio Grande flows silently, mostly undisturbed by illegal crossings at the end of January on a rare rainy day in south Texas. With illegal immigration taking front and center stage in the upcoming presidential race, Resident Biden understands that Mexican President Andres Manuel Lopez Obrador needs “to keep a lid on the crisis” until after the November election. “One of the things that they have asked the Biden administration to do is to crack down on Texas,” “The Mexican state and the cartels are not antagonists to one another.” Officials in Mexico have openly called for President Biden to stop Texas from interfering with the flow of illegal immigrants. The Biden administration did just that immediately after Secretary of State Antony Blinken and Homeland Security Secretary Alejandro Mayorkas met with President Obrador in late December 2023. “It is not coincidental that literally 24 hours later, the Department of Justice announced this lawsuit against the enactment of SB 4 in Texas, which is the law that gives Texas the ability to arrest and deport,” Mr. Paxton accused the federal government of shirking its responsibility to uphold Article IV of the U.S. Constitution, which guarantees protection against invaders. On the horizon is Texas Senate Bill 4, signed by Mr. Abbott in December 2023, and which has already been challenged by the Biden administration. The law, which goes into effect in March, makes crossing illegally into Texas a state crime, giving all law enforcement in the state the power to arrest illegal immigrants on felony charges of unlawful entry from a foreign nation. It carries a penalty of up to 20 years in prison. It also allows state judges to issue de facto deportation orders against violators of the law, though it’s unclear how Texas would enforce the provision. It allows illegal invaders to enter our country at a rate of 5,000 per week or 8,500 illegals in a single day! Everything about this bill is anti-American! The bill needs to be buried and burned and everyone that is trying to get this bill enacted needs to be removed from office! Senators Lankford, Sinema, and Murphy have agreed on a bipartisan immigration bill. According to Axios, the agreement would force the government to automatically reject migrants and asylum seekers from crossing the border illegally once the daily average for border crossings surpasses 5,000 over a week or crossings surpass 8,500 on a single day (nearly 2 million per year which is higher than any given year under any other president aside from Biden). Yet even after that 5,000 number is reached, migrants could receive waivers for humanitarian reasons. The bill would also limit humanitarian parole, which has been wholly abused under both Obama and Biden’s presidencies. Yet the current law on parole states it can only be done on a “case-by-case basis.” If President Biden is already ignoring the law as written, he will likely ignore any changes as well. States have tried to take him to court on it, but the courts have refused to grant the states’s standing. The bill also increases work visas and reduces wait time for asylum seekers to get work permits, which is what Democrats like AOC and Schumer have been begging for. The number of asylum seekers living in blue cities is putting them on track to bankrupt those cities unless migrants can become a new base of taxpayers. Another key component of the bill is that Mexico would have to agree to the expulsion authority as it did during Remain in Mexico and Title 42, but no such agreement has been reached. Minority Leader Mitch McConnell told fellow Senators that Republicans were bowing to Trump’s will and not going along with any bill that could fix the border issue because he wanted to run on it in 2024. Quite possibly one of the stupidest things you could utter out loud. Of course, the media jumped all over it, allowing them to say that Republicans owned this crisis, which is exactly what Biden wanted. Since then, McConnell has backtracked, but it’s already too late. Meanwhile, Speaker Johnson is holding firm that he will not consider any immigration proposals that do not include HR 2, which would bring asylum reform. The truth is that the President already has every executive authority necessary to stop the border crisis. The idea that the U.S. has lasted for longer than 200 years and a dozen wars before Congress decided to grant power to the executive branch to deter an invasion is ludicrous. Section 212(f) of the Immigration and Nationality Act allows any president to turn away any alien or class of aliens as he sees fit. President Biden needs no additional authority to stop what’s going on than Eisenhower did when he launched Operation Wetback. As I wrote earlier in the week, Congress granted more powers to the executive during the 1990s under Bill Clinton. The truth is Joe Biden is currently failing to enforce dozens of immigration laws per day. There’s absolutely no proof that he will change his mind regarding this agreement.
